Terms of Service and Refund Policy

Please read these Terms of Service and Refund Policy carefully before purchasing from Whiskit LLC, doing business as Whiskit (collectively referred to as "the Bakery"). By placing an order on our website, you agree to be bound by these terms.

  1. Colorado Cottage Food Act Compliance
    All products sold through this website are produced in a home kitchen under the Colorado Cottage Foods Act.

  • Mandatory Legal Disclaimer: This product was produced in a home kitchen that is not subject to state licensure or inspection and that may also process common food allergies such as tree nuts, peanuts, eggs, soy, wheat, milk, fish and crustacean shellfish. This product is not intended for resale.

  • Geographic Restrictions: In accordance with Colorado law, our food products are exclusively available for direct-to-consumer sales within the state of Colorado. We cannot and will not ship any food items out of state. Any orders placed requesting out-of-state shipping will be immediately cancelled and refunded.

  1. Ordering and Payment
    Payment must be completed in full through our website before your order is added to our baking schedule. For custom orders, deposits and final payments must meet the timelines specified during your initial consultation.

  2. Food Safety, Storage, and Allergens
    Our baked goods are legally classified as non-potentially hazardous and do not require refrigeration for safety. However, proper storage is the customer's responsibility. We are not liable for melting, damage, or degradation of the product after it leaves our possession.

  • Allergen Notice: Our home kitchen processes foods containing tree nuts, peanuts, eggs, soy, wheat, milk, fish, and crustacean shellfish. We cannot guarantee a 100% allergen-free environment.

  1. Returns, Cancellations, and Refunds
    Because our food items are freshly prepared and highly perishable, all sales are final.

  • No Returns: We do not offer cash refunds or accept returns based on personal flavor preferences, textures, or standard cosmetic variations.

  • Cancellations: Orders cancelled more than 7 days before the scheduled pickup/delivery window will receive a full refund. Cancellations made inside this 7-day window are strictly non-refundable, as custom prep work and ingredient sourcing have already begun.

  • Abandoned Orders: Orders not picked up within 24 hours of your scheduled pickup time will be forfeited without a refund.

  • Quality Issues: If there is a legitimate physical defect with your order (such as an incorrect flavor baked or an undercooked center), you must contact us within 24 hours of pickup with photographic evidence so we can evaluate the issue and issue a replacement or store credit.
